Terms and Conditions<\/h2>\n\n<h3 class=\"wp-block-heading\">1.1 Definitions<\/h3>\n\n<p class=\"wp-block-paragraph\">To the extent applicable, the following definitions apply:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>\u201cCustomer\u201d means any individual or legal entity that purchases products through the Store\u2019s website.<\/li>\n\n\n\n<li>\u201cStore\u201d \/ \u201cWe\u201d refers to the company that operates the website and sells food products.<\/li>\n\n\n\n<li>\u201cProducts\u201d means the food items, drinks, and non-food items offered for sale on v12.ProntoGourmet.pt.  <\/li>\n\n\n\n<li>\u201cPlatform\u201d or \u201cWebsite\u201d refers to the Store\u2019s online site where the Customer can place orders\u2014prontogourmet.pt.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.2 Acceptance of the Terms<\/h3>\n\n<p class=\"wp-block-paragraph\">By accessing and using the Website, or by placing an order, the Customer accepts and is bound by these Terms and Conditions, as well as by any return, shipping, or other policies that are expressly referenced.<\/p>\n\n<h3 class=\"wp-block-heading\">1.3 Purpose<\/h3>\n\n<p class=\"wp-block-paragraph\">These Terms and Conditions govern the sale of food products through the Website, as well as the rights and obligations of the Store and the Customer regarding the ordering, payment, shipping, and return processes, and other stages of the transaction.<\/p>\n\n<h3 class=\"wp-block-heading\">1.4 Store Information<\/h3>\n\n<p class=\"wp-block-paragraph\">Fluke Unipessoal, Lda., owner of the URL v12.ProntoGourmet.pt, with headquarters at Av. da Peregrina\u00e7\u00e3o, No. 10, Atrio 7, 7A, 1990-384 Lisbon, and Tax ID No.: PT509857345. Pedro I, No. 7, 2510-453 Praia del Rey-\u00d3bidos.<\/p>\n\n<h3 class=\"wp-block-heading\">1.5 Orders<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The Customer selects the Products on the Website, proceeds to checkout, and chooses a payment method and shipping method.<\/li>\n\n\n\n<li>We only deliver to the delivery areas listed on the website.  <a href=\"https:\/\/prontogourmet.pt\/en\/delivery-zones\/\">Delivery areas \u2013 Pronto Gourmet, Home Delivery Service for Pre-Cooked Meals, Drinks, and Groceries<\/a><\/li>\n\n\n\n<li>The order is considered accepted and binding upon written confirmation by the Store via email and after payment has been verified, when applicable.<\/li>\n\n\n\n<li>The Store reserves the right to refuse an order in the event of insufficient stock, a pricing error, or a breach by the Customer.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.6 Prices and Payment<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The prices of the Products listed on the Website include VAT at the applicable statutory rate.<\/li>\n\n\n\n<li>The Customer agrees to pay the order total, plus any shipping costs or other additional charges that are clearly indicated.<\/li>\n\n\n\n<li>The accepted payment methods are those listed on the website.<\/li>\n\n\n\n<li>In the event of payment by credit card or other electronic means, the Store assumes no liability for any payment system failures that are not attributable to it.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.7 Shipping and Delivery<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The Store will ship the Products to the address provided by the Customer, within the specified Delivery areas, within the estimated timeframe indicated on the website and\/or on the date selected at checkout. &#8211; <a href=\"https:\/\/prontogourmet.pt\/en\/delivery-zones\/\">Delivery areas \u2013 Pronto Gourmet, Residential Pre-Cooked Meals Service, Drinks, and Groceries<\/a> <\/li>\n\n\n\n<li>Shipping risks are transferred to the Customer upon delivery to the carrier or to the Customer (depending on the circumstances and the size of the order).<\/li>\n\n\n\n<li>It is the Customer\u2019s responsibility to provide the correct address, phone number, and other information necessary for delivery. In the event of an error, the Customer may be responsible for any additional costs. <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.8 Returns and Refunds<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>Since this involves the sale of food products, the specific legal rules for perishable goods and items intended for immediate consumption apply; therefore, returns are not accepted.<\/li>\n\n\n\n<li>An exception applies to drinks and\/or grocery items with a shelf life of more than 6 months that are undamaged, unaltered, and show no signs of deterioration; for these items, the return period is 14 consecutive days after delivery.  <\/li>\n\n\n\n<li>The Customer must report any anomalies or defects in the Products received at the time of delivery.<\/li>\n\n\n\n<li>In the event of a defect or nonconformity, the Customer\u2019s legal right to repair, replacement, or refund shall apply, in accordance with applicable consumer protection laws.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.9 Warranties and Liability<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The Store guarantees that the Products delivered conform to the advertised specifications and are fit for consumption.<\/li>\n\n\n\n<li>The Store&#8217;s liability for indirect or consequential damages is limited to the amount of the order, to the extent permitted by applicable law.<\/li>\n\n\n\n<li>The Store is not liable for any failure on the part of the Customer (e.g., improper storage or preparation of food after delivery).<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.10 Data Protection and Privacy<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The Customer&#8217;s personal data is processed in accordance with the Store&#8217;s privacy policy.  <a href=\"https:\/\/prontogourmet.pt\/en\/?page_id=5626\">Privacy Policy \u2013 Pronto Gourmet, Home Delivery Service for Pre-Cooked Meals, Drinks, and Groceries<\/a> <\/li>\n\n\n\n<li>The Customer authorizes the Store to process their data for the purposes of fulfilling the order, sending marketing communications (when consent is given), billing, and complying with legal obligations.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.11 Intellectual Property<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>All content on the Website (text, images, trademarks, logos) is the property of the Store or third-party licensors, and reproduction without express authorization is prohibited.<\/li>\n\n\n\n<li>The Customer warrants that any content it may submit (comments, reviews) does not infringe the rights of third parties and assumes responsibility for such content.<\/li>\n\n\n\n<li>The website&#8217;s content includes, among other things, images used under the <a href=\"https:\/\/unsplash.com\/pt-br\/licen%C3%A7a\">Unsplash Free-to-Use License<\/a>.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.12 Changes to the Terms<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>The Store reserves the right to change these Terms at any time. In the event of significant changes, these will be communicated and will apply to orders placed after the date the new version is published. <\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">1.13 Governing Law and Jurisdiction<\/h3>\n\n<ul class=\"wp-block-list\">\n<li>These Terms shall be governed by Portuguese law.<\/li>\n\n\n\n<li>For any dispute arising from these Terms, the parties agree to submit to the jurisdiction of the District Court of Lisbon, unless otherwise required by law.<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>1.
